Kazakhstan tax essentials: VAT, withholding tax and permanent establishment
The Kazakh tax system is not complicated in itself, but for a Chinese company that is resident abroad while operating in-country, the risk concentrates in two places: withholding tax and permanent establishment.
Main taxes
| Tax | Common rate | Notes |
|---|---|---|
| Corporate income tax | 20% | Standard rate; specific sectors have separate rules |
| VAT | 12% | Registration threshold applies; cross-border services need case-by-case analysis |
| Personal income tax | 10% | Resident taxpayers |
| Social tax | approx. 9.5% | Linked to the payroll fund |
| Withholding tax | 5%–20% | Depends on income type; treaty relief may apply |
Rates and thresholds change with the legislation. Before signing, rely on the rules in force at that time and on the view of a licensed local adviser.
Withholding tax: when it is triggered
When paying dividends, interest, royalties or service fees to an overseas entity, the payer usually has a withholding obligation. The China–Kazakhstan tax treaty offers reduced rates on some income, but treaty relief must be applied for — it does not apply automatically. Without a residency certificate and the application prepared in advance, the payment is withheld at domestic rates.
Permanent establishment: an office is not the only test
Employees providing services in-country beyond a set number of days, a fixed place of business, or a dependent agent can all create a permanent establishment. Once one exists, in-country source income must be declared and taxed locally, not merely subjected to withholding.
What decides the question is how long staff are actually present and what the services are, not how the contract words it. Project-based delivery (installation, commissioning, training) is the most common trigger.
Three practical measures
- Before signing, decide whether a permanent establishment will arise, and only then decide which party signs the contract;
- Where cross-border service fees are involved, prepare the treaty relief application in advance;
- Keep a filing calendar with reminders set to the local filing cycle — late-filing penalties accrue per occurrence and are unrelated to the tax amount.
This note reflects practical experience and is not tax advice. Application in a specific case is governed by the local tax authority and licensed professional advisers.
